Atlético-GO perde mando de campo e é multado por caso envolvendo jogador do Goiás; entenda
Episódio ocorreu em um clássico pelo Brasileirão
Em resumo, no início de maio, em duelo pela 5ª rodada do Brasileirão, o Goiás venceu o Atlético-GO por 1 x 0. No entanto, o jogo foi marcado por um episódio de injúria racional envolvendo o meia esmeraldino Fellipe Bastos e um torcedor do Dragão. Em seguida, o jogador fez registrou boletim de ocorrência.
A partir disso, nesta terça-feira (26), a Segunda Comissão Disciplinar do Superior Tribunal de Justiça Desportiva do Futebol (STJD) publicou as punições envolvendo o Dragão. A saber, com base no artigo 243-G do CBJD, o clube terá que pagar multa de R$ 50 mil e ainda perderá um mando de campo.
Advogado do clube rubro-negro questionou decisão
Por sua vez, o Dr. Paulo Henrique Pinheiro, advogado do Atlético-GO, afirmou que irá recorrer. Além disso, questionou ainda a fragilidade do processo e ausência de conteúdo probatório para punição do clube.
“A denúncia é específica no parágrafo segundo do artigo em que a Procuradoria pede apenas a pena de multa. A denúncia baseia-se exclusivamente no depoimento do atleta. A Procuradoria não requereu oitiva de nenhum outro atleta e de ninguém da Comissão Técnica para confirmar o fato. Apenas o supervisor do Goiás foi ouvido e disse que só tomou conhecimento no vestiário e não presenciou o fato.
Em todas as imagens juntadas nos autos, em nenhuma delas há prova que corrobora a prática da infração do artigo 243-G. Por mais que a infração possa ser grave, se não há prova irretorquível, cristalina e indiscutível, não se pode condenar um clube, uma torcida ou qualquer outro indivíduo sob risco de se cometer elevada injustiça. Se esse contexto probatório se mostra frágil, não há prova efetiva da autoria da pessoa, não há como punir.
Motivo pelo qual deve prevalecer o princípio do ‘In dubio pro reo’. Que seja o Atlético-GO absolvido. Caso não seja esse o entendimento, que apliquem a pena mínima pela ausência de reincidência específica, pelas condutas preventivas e repressivas, por colaborar em todos os atos do processo e por ser um clube com menor capacidade financeira”, declarou o Dr. Paulo Henrique Pinheiro.
Presidente da Segunda Comissão, o auditor Felipe Silva concluiu a votação
“O racismo não pode ser tolerado e tem que ser reprimido e rechaçado em qualquer seara seja civil, desportiva ou criminal. Considero que restou caracterizada a atitude do torcedor e reputo necessária punição da agremiação, uma vez não houve a identificação do torcedor. Se houve a possibilidade de identificar que o torcedor não fazia parte do clube e de organizadas, então me parece que houve a possibilidade clara de identificação, não menosprezando os esforços que o clube afirma ter feito. Acompanho o voto do relator na multa e perda de um mando de campo.”

O Dragão volta a campo já nesta quarta-feira (27), às 21h30. Assim, no Estádio Antônio Accioly, em Goiânia, a equipe encara o Corinthians pelo jogo de ida das quartas de final da Copa do Brasil.
